Founded in 1984, the CAS is a global arbitration body that arbitrates disputes pertaining to sports.
As she advanced to the women’s 50 kg final at the ongoing Paris Olympics 2024, Vinesh Phogat was in imperious form. However, Lady Luck had other ideas, as Phogat was disqualified from the final after just missing the weight retirement by a mere 100 grams. She had previously made history as the first female wrestler from India to advance to the Olympic final.
Phogat has since requested permission to compete for gold by appealing to the Court of Arbitration for Sports (CAS). She has asked to receive a joint silver medal if it is approved. On Thursday, the interim decision from CAS is anticipated.
Founded in 1984, the CAS is a global arbitration body that arbitrates disputes pertaining to sports. The courts of the CAS are in Lausanne, Sydney, and New York, while the organization’s headquarters are in Switzerland. The cities that are currently hosting the Olympics have also set up temporary courts.
John Coates, who was appointed in 2011, is the president of CAS at the moment. Only if recourse to the CAS is specified in an arbitration agreement between the parties may a dispute be brought before the CAS. Furthermore, only CAS may hear disputes pertaining to Olympic games, and all international federations of Olympic sports have acknowledged the authority of the CA to hear certain disputes.
IOC president Juan Antonia Samaranch first came up with the idea for the CAS to resolve conflicts during the Olympics. In 1984, it was established as a component of IOC. All signatories, including national Olympic committees and Olympic international federations, have consented to the jurisdiction of the CAS for anti-doping rule violations through agreement with the 2009 World Anti-Doping Code.
The IOC disciplinary commission was replaced in 2016 by an anti-doping division of CAS judges, who specialize in doping cases at the Olympic games. Decisions rendered by the CAS, a Swiss arbitration organization, may also be appealed to the Federal Supreme Court of Switzerland.
